Penalties That Apply to Aggravated Assault. A fourth degree aggravated assault results in a fine of up to $10,000 and a prison term of up to 18 months. Third degree aggravated assault carries a maximum fine of $15,000 and incarceration that can reach 5 years. Second degree aggravated assault triggers maximum penalties that include a $150,000 fine and 10 years in state prison. You should also know that the NERA imposes a requirement that an individual serve at least 85% of his jail sentence before eligible for parole.
