Possession or Use of a Fake ID

N.J.S.A. 2C:21-2.1 makes it a third degree crime to knowingly exhibit, display or present a driver' s license, birth certificate, or other governmental document that is forged, fraudulent or otherwise falsely represents a person's identity or age. There are five (5) elements that must be proven by the prosecutor in order to convict someone for using or attempting to use a fake id.  First, the document must have been a driver's license or other document issued by a governmental agency. Second, the item presented must be a forgery or fake. Third, the form of document must be one typically used to verify identity, age or other personal information. Fourth, the accused must have exhibited, presented or displayed the document. Fifth, the accused must have known that the driver's license or other document was fake. Please note, however, that an exception is created under 2C:21-2.1 for those who use a fraudulent/fake identification in order to obtain alcoholic beverages underage.

There are two additional charges that may be filed by police. N.J.S.A. 2C:28-7 bars tampering with public records. It is a disorderly persons offense to falsify or use a government document that is forged, false or fraudulent. N.J.S.A. 33:1-81 prohibits misrepresenting age for the purpose of purchasing alcohol or obtaining admission to an establishment that serves alcohol. A conviction for either of these offenses results in a fine of at least $500 and as much as $1,000 and up to 6 months in jail. There is also a 6 month driver's license suspension that may be imposed by the sentencing judge. A collateral consequence of a plea or finding of guilt is a criminal record that will follow you around for years.
