Ignition Interlock

Berkeley NJ DUI Lawyers

The penalties for DWI, DUI and Breath Test Refusal were significantly modified in 2010 to incorporation an ignition interlock obligation for those convicted in Berkeley NJ and other jurisdiction throughout the state. This device prevents an automobile from starting unless and until the motorist provides a breath sample. If the the blood alcohol concentration ("BAC") of the driver exceeds a threshold of .05%, the car will not start. For those charged and convicted of a second or subsequent DWI or Refusal, installation of an ignition interlock is mandatory. Ignition Interlock Requirements in New Jersey

First Offense DWI or Refusal

If you refused or submitted a breath sample of at least.15%, you are required. Imposition of this requirement is discretionary where the BAC is below .15%.

Interlock must be installed for the duration of the suspension plus 6-12 months following restoration

Second Offense DWI or Refusal

Period of suspension plus 1-3 years once privileges are restored.

Third Offense DWI or Refusal

Same as second offense.

Failure to Satisfy the Requirement

If you fail to comply with the ignition interlock requirement, a license will be reimposed. It is also possible for you to be ordered to return to court and face further punishment, including jail.

Individuals Who Do Not Operate a Vehicle

The obligation applies to any and all motor vehicles that you operate. In other words, you cannot operate a car or truck during the interlock period unless it is fitted with this ignition device. You do not need to install an ignition interlock if you are not driving but you also do not need to be restored if this is the case as New Jersey DMV issues identification only licenses.

What Clients Say About Our Ocean County Criminal Defense Attorneys
Exemplary attorneys. I hired them for a DUI and an expungement. I was happy with the results for both cases. Special thank you to Samera for always answering all of my calls and questions JC
I'm 45 years old and this was my first time ever getting in trouble with the law. I was in need of a lawyer and after careful research, I called John F. Marshall Attorneys and was introduced to Abe Basch. Abe was professional, supportive and very thorough. I had three charges against me, one civil and two criminal. I was so scared and expressed that to Abe. The first day I had to go to court, I was an absolute nervous wreck but Abe prepped me and kept my anxiety levels down by going over the process of the courts thoroughly with me. He fought to get my charges dismissed and won all three cases (two court appearances). Abe is positive, confident and he ensured I felt the same way. I'd like to say thank you to Abe for working so diligently on my cases to get them dismissed. I feel like a weight has been lifted off my chest! I highly recommend Abe for any charges you may be faced with. Rose C.
